Civil Litigation, Business Litigation, Contract Disputes, Experienced Trial Lawyer.

Timothy R. Pack is an accomplished Utah civil trial lawyer practicing in the areas of civil litigation, business litigation, partnership disputes, construction, real estate litigation, contract disputes, and water rights disputes. He is known for his strategic judgment and experience in the courtroom. Tim represents businesses, government entities, and individuals in cases where the outcome truly matters. He has prevailed in hundreds of cases in advance of trial and negotiated numerous favorable settlements for his clients.

Business and Partnership Litigation

Tim is frequently retained as a partnership dispute lawyer in Utah when business owners face deadlock, fiduciary-duty claims, mismanagement and misappropriation, or the breakdown of closely held companies.

Real Estate Litigation

Tim regularly represents clients in real estate, land use and development disputes. He aggressively represents both individuals and developers in complex contract, quiet title, trespass, and boundary disputes across Utah. In addition, Tim is also known for his deep experience in water-rights disputes, including interference claims, forfeiture actions, general adjudication, and appeals from State Engineer decisions.

Breach of Fiduciary Duty Litigation

A fiduciary owes the highest duties under the law. Tim acts decisively to stop trustee and manager misconduct, as well as misappropriation of assets and funds. He has been successful at removing trustees, stopping bad actors from breaching their fiduciary duties, and protecting families and corporations from future misconduct.

Construction Litigation

Tim represents contractors, subcontractors, suppliers, design professionals, and homeowners in resolving complex construction disputes. He recently obtained a six-figure award in a three day arbitration trial against a developer related to construction defects.
